Once you confirm your reservation, your broker will process your payment.

• If you are booking for a single day and your reservation is confirmed more than 7 days in advance, a deposit of either $1,000 USD or 50% of the total cost of the reservation (whichever is greater) is processed immediately in order to hold the yacht. Once your embarkation date is 7 days away, the remainder of the amount due is processed.
• If you are booking for a single day and your reservation is made 7 days or less in advance, the total price of your reservation is processed immediately.
• If you are booking for a multi-day charter and your reservation is confirmed more than 30 days in advance, a deposit of 50% of the cost of the yacht is processed immediately in order to hold the yacht. Once your embarkation date is 30 days away, the other 50% is collected for the price of the yacht, plus the APA, plus the taxes due.

Terms of refunds are dictated by the Charter Agreement. Generally, once a payment is collected, it is non-refundable. In certain circumstances, as dictated by the Charter Agreement, credits can be provided so you will be able to enjoy your yacht charter at a future date that is convenient for you.

A yacht charter in the US Virgin Islands is a fantastic way to explore the beauty of the Caribbean, and getting to the USVI is so easy, with direct connections from many major US Cities. Fly directly into St. Thomas and start your charter from Charlotte Amalie Harbor.

Nearby, St. John offers top-notch snorkeling at Trunk Bay, dubbed one of the world’s most picturesque beaches , and upscale vibes at Caneel Bay.

Down south in St. Croix, Christiansted offers cool colonial architecture and a lively scene, while Fredericksted is perfect for sunset views and calm dives.

You can also jump across to the British Virgin Islands . It’s just a short sail to Tortola and Virgin Gorda, where the iconic Baths National Park awaits.

Note that not all charter yachts have permits to cruise in the BVI , so make sure you check this with your broker beforehand.

As for the types of yachts, you have a range from sailing yachts and catamarans to motor yachts , with catamarans being particularly popular for their stability, spaciousness, and affordability.

We have also seen a growing demand for luxury experiences , which has brought bigger and more luxurious motor yachts to the USVI. These yachts offer high-end amenities like Jacuzzis , spas, gyms, and l arge selections of water toys like jet skis and even mini submersibles, essentially serving as floating luxury hotels.

Note: while the BVI has a ban on Jet Skis, the USVI does not!!

Sailing yachts are also available and are a great option for those who wish for a more traditional experience with sailing in focus—the weather conditions are definitely ideal for it!

But sailing yachts also do come with some limitations, as the water in the Virgin Islands, especially in the British Virgin Islands, is very shallow , and monohulls generally are deep drafted , limiting where they can go and how close to the beaches they can anchor.

APA vs All-Inclusive Yacht Charters

When planning to charter a catamaran in the US Virgin Islands, there are two main options to consider: APA (Advance Provisioning Allowance) yacht charters and All-Inclusive yacht charters .

When choosing between an APA yacht charter and an all-inclusive yacht charter, clients should consider their desired level of customization , budget flexibility, and overall vacation experience. Both options offer unique advantages, and understanding the regional differences in the Mediterranean and Caribbean will help clients make an informed decision to ensure an unforgettable yachting vacation.

APA YACHT CHARTER

An APA yacht charter is popular for clients seeking a customized, high-end experience. In this charter arrangement, the client pays a base fee for the yacht rental and crew. On top of this base fee, an advance provisioning allowance (APA) is added, typically around 20-30% of the yacht’s base rental cost. This APA is intended to cover expenses such as food, beverages, fuel, marina fees, and any other costs that might arise during the charter.

ALL-INCLUSIVE YACHT CHARTER

In contrast, an all-inclusive yacht charter offers a hassle-free experience with a set price that covers all expenses related to the yacht, crew, food, beverages, and activities. Clients can relax and enjoy their vacation without worrying about additional costs or budgeting for unexpected expenses. STARTING AND ENDING IN ST. THOMAS

DAY 1 | Yacht Haven Grand – Trunk Bay, St. John

DISTANCE: 12nm DURATION: 1 hour

A jewel in the crown of the US Virgin Islands National Park, Trunk Bay is forever collecting accolades for being one of the most beautiful beaches in the world.

Backed by dark green forests that run down to meet the satin-colored sands and the endless hues of blue, Trunk Bay is perfect for dropping anchor with a rum in hand or ducking underwater to follow the coral trail.

There’s something about Trunk Bay that seems gloriously untouched. The coral trail runs on for 225 yards and teems with coral and colored fish.

For those who prefer to prop up on the sands, the beach is well served with sun chairs, food and drink stands, and everything you need to stay put in paradise all day.

DAY 2 | Trunk Bay – Tortola Island

DISTANCE: 11nm DURATION: 1 hour

Tortola is the largest island of the British Virgin Islands and is one of the best-known yacht spots in the Caribbean.

The busy harbor at Cane Garden Bay is the charter boat capital of the Caribbean, and with good reason—along with some interesting ruins and the fabulous National Park at the top of Mount Sage, Tortola offers spectacular powdery white, sandy beaches, wonderful snorkeling opportunities, and fantastic restaurants and bars that serve local brew.

A visit to the Callwood Rum Distillery and a stroll around Craft’s Alive Village for souvenir shopping are musts.

Also don’t miss a visit to Smuggler’s Cove, a perfect shallow reef ideal for scuba beginners and untouched by civilization.

DAY 3 | Tortola Island – The Baths, Virgin Gorda

DISTANCE: 10nm DURATION: 1 hour

The unrivaled star of the Virgin Gorda – The Baths is a fairytale destination for any yacht charter crowd.

As one of the best beaches in the Caribbean, you will love this landscape of pink granite slabs, hidden coves, cathedral-like caves, and shimmering saltwater pools, all perched on the edge of the sea.

The boulders have been adorned with ladders and ropes so you can climb and cross this natural obstacle course.

Wallow in the warm rock water pools, soak up the sun on your favourite boulder, and be enchanted by the natural grottos.

When you need a hint of refreshment, the nearby yacht club will tempt you in with long lavish lunches and afternoons being pampered at the spa.

DAY 4 | The Baths – Anegada Island

DISTANCE: 23nm DURATION: 2 hour

Anegada is a coral island and the northernmost island of the BVI group. It should not be missed thanks to its beautiful white sand beaches, quaint beach shacks, and the large horseshoe-shaped reef that protects its immaculate shores.

This unique island is the only inhabited island in the British Virgin Islands that is not volcanic. This low-lying island, with the highest point of only 28 ft (8.5m), is made up of coral and limestone and is surrounded by one of the world’s largest reefs.

The island is also known for its large salt ponds which used to be home to thousands of flamingos which were caught for food and their feathers during the 19th & 20th centuries. They have recently been re-introduced to the island and the population is flourishing. Anegada also boasts several species of turtles and the endangered rock iguana.

DAY 5 | Anegada Island – Dog Island

DISTANCE: 17nm DURATION: 1.5 hour

Named by sailors who would pass through these parts and assume that the noise of barking seals was actually dogs, Dog Island boasts five uninhabited islands sitting west of the Virgin Gorda.

George Dog offers a national trust mooring, and with exceptional visibility, a movie-set-like backdrop, and a local favorite lunch spot, it’s a must for snorkeling and diving enthusiasts.

Beneath the blue, you can swim alongside rays, garden eels, the brightest shoals of fish, and wise old turtles.

The other dogs have no real beaches to speak of, but for those who want to visit a number of top-tier snorkelling spots, including Bronco Billy, which is rumored to be a favorite of Jacque Cousteau’s, the dogs are a dream

DAY 6 | Dog Island – Jost Van Dyke

DISTANCE: 18nm DURATION: 1.5 hour

Named after an early Dutch settler, Jost Van Dyke is a small picturesque island northwest of Tortola. At 4 miles long, the island is home to only a few hundred permanent residents and is known for its idyllic yacht anchorages.

Connect yourself with the local culture at White Bay – a magical place of positive energy in BVI yacht charters and a famous meeting place for sailors.

Swim from your boat to the famous Soggy Dollar bar for a painkiller. Hang out in the hammock in Hendo’s Hideout, get a roti or seafood, and relax on the beach. Weekends are more party-like, with day trips from USVI filling the beach bars.

DAY 7 | Dog Island – Cruz Bay, St. John

DISTANCE: 7nm DURATION: 40 min

Cruz Bay is the perfect place to finish off a Virgin Island yacht charter for those who are craving a little civilization after the serene anchors at some of the Virgin Islands’ most remote cays. The main town on the island is where you will find a wealth of ritzy restaurants, boutique shops, buzzing bars, and high-class hotels.

As the largest commercial hub on St John’s and with over two-thirds of the island being a national park, this is where the action and cultural offerings are centered. Guests can catch local art and history at the Elaine Ione Sprauve Museum.

For those who want to follow their passion for outdoor pursuits, there’s snorkeling at the nearby Hawksnest Bay and 4X4 land adventures by jeep.

Our Favorite Destinations in the US Virgin Islands

Located on the northern shores of St. John, Maho Bay offers a serene retreat for yacht charters seeking respite in the beautiful nature. With its turquoise water and white beach voted “Visitor’s Favorite Beach ,” Maho Bay provides an ideal setting for both relaxation and exploration. Charter guests can also enjoy activities such as snorkeling among vibrant coral reefs , kayaking, or paddleboarding along the coastline.

Our #1 recommendation for Maho Bay is a snorkeling trip to see the sea turtles and rays that feed in the sea grass just off the beach.

Along the eastern shoreline running out to the point separating Little Maho from Maho Bay Beach, you will find patches of reef with a wide variety of corals and abundant marine life. The water is shallow (between 3 to 10 feet deep) , giving snorkelers easy access to the coral, which includes species such as purple sea fans, sponges, anemones, and hard corals like Mustard coral, brain corals, and Elkhorn. You will also find a diverse fish life , with many varieties of wrasse, damsel, tangs, parrot fish, angelfish, and lionfish.

Along the western shoreline between Maho and Cinnamon Bay , you will also find excellent snorkeling opportunities, with coral and fish becoming more plentiful further from the beach. Snorkeling in shallow waters ranging from 3 to 12 feet deep, even novice snorkelers can enjoy a variety of marine life. While snorkeling, keep an eye out for Nurse sharks , which are slow-moving and not a threat but should not be disturbed.

Coral Habor

Located on the eastern shores of St. John in Coral Bay, Coral Harbor is a premier destination for yacht charters, offering a mix of natural beauty, cultural charm, and recreational opportunities.

Francis Bay

Visit Francis Bay and you will find yourself on one of St. John’s longest beaches . This beautiful beach has calm waters and a lovely, sandy shore. On weekdays, this beach is not too crowded, and it is easy to find a private spot.

The Francis Bay Trail runs along the salt pond located just inland of the beach and is an excellent place for bird watching , especially early in the morning.

The best snorkeling in Francis Bay can be found on the eastern and western ends. They provide some ideal snorkeling opportunities . It’s not uncommon to see green sea turtles near the seagrass beds on this part of Francis Bay Beach.

You can also find other marine life common in the Virgin Islands like rays , colorful fish like honeycomb cowfish and butterflyfish, and plenty of coral. If you’re lucky you might catch sight of squid. You need to diligently look out for them as they’re not always easy to spot among the many different places in the Virgin Islands National Park.

Recommended moorings and anchorages around St Thomas:

Magen's Bay - Located on the north side of St Thomas you will find this stunning one mile long, white sandy anchorage.  Known for its calm, clear waters and pristine one mile long beach, Magen's is often sited as one of the world's most beautiful beaches.  

There are no mooring balls in Magen's Bay, but there is plenty of nice sea bottom for dropping anchor.  When you go ashore, you will need to pay for entering the park.  Typically $5 for non-residents.  This bay is part of a protected area, managed by the Magen's Bay Authority.  The beach and surrounding land were donated to the people of the Virgin Islands by Arthur Fairchild in 1946.

​Secret Harbor  - Located on the east end of St Thomas just one bay over from Compass Point Marina, Secret Harbor can be a great place to spend your entire last day. 

There are a limited number of mooring balls in Secret Harbor and several PRIVATE mooring balls.  Please make sure you do not pick up a private ball.  

If you need to drop anchor here, try to tuck in as closely as possible while still maintaining a safe distance from the shore and other boats.  You don't have to be very far out to be in rougher water and if there is a bit of a swell, it will be better to move across to Great St James for the night.

​Long Bay (Downtown Moorings and Yacht Haven Grande)  - This is the main harbor on St Thomas in Charlotte Amalie.  It can often times be quite choppy due to the water bouncing off the retention walls surrounding the entire bay.  There are first come, first served mooring balls in Long Bay and you can find specific locations through the Boaty Ball website.  BoatyBall.com

You may also reserve a slip at Yacht Haven Grande for the night.  Keep in mind, the docks here are mostly concrete and very tall as they are set up more for super yachts.  You will have to be extra vigilant in the way you tie up your lines to the dock to avoid chaffing.  Those docks will easily cut through your line if not tied off properly.

Long Bay and Crown Bay are where visiting cruise ships dock, so this area can become quite congested.  Be sure to check cruise ship schedules.

​Lindberg and Brewers Bay on the West End of St Thomas  - If you are planning to visit the Spanish Virgin Islands, these two bays are our recommendation for the night before you sail to the SVI's.  You will want to make sure everything is working properly on your boat and either one of these locations is a good jumping off point for the SVI.  

There are no facilities in Brewers Bay, but it is a great location to watch airplanes and it is a very calm anchorage with public mooring balls.

In Lindberg Bay there is Emerald Bay Beach Resort, there are restrooms and Caribbean Fusion Bar and Grill or visit the snack bar.

You may also use their beach without purchasing a day pass.

You can reserve a floating cabana, jet skis, and many other things through Calypso Watersports. 

Water Island  - This is the fourth and lesser known of the main US Virgin Islands.  It is approximately 500 acres in size and located about a half-mile south of St Thomas (near sub-base).  If visiting Water Island you'll want to anchor in the Honeymoon Beach area.  There are no public mooring balls here.  Be sure to dive your anchor.   ​​

Dinghy's Beach Bar and Grill and Heidi's Honeymoon Grill are both located here and this is a great place to spend an entire day.  

Golf carts are the primary mode of transportation on island and you can rent one from Rachel at rachelsrentals.com . 

​Not much in the way of amenities.

Little and Great St James - These are small private islands southeast of St Thomas and just a few minutes outside of our marina, Compass Point.  Unfortunately, made famous as "Epstein Island" these islands have since be purchased by Stephen Deckoff, with SD Investments LLC for a whopping $60 million.

Great St James is the location of Pizza Pi, a floating pizza boat and is a favorite spot for the last night of charter.  Just a 20-30 minute motor from the channel at Compass Point, it makes for an easy hop the morning of your departure. ​​ ​

There's great snorkeling here around both islands!

St John, USVI

St John is where our charter guest spend the majority of their time within the USVI.  Especially, those who are going over to the British Virgin Islands.  

St John  is known for its pristine beaches, lush tropical forests, and clear waters ideal for snorkeling and diving. The island is relatively small, covering about 20 square miles.

A significant portion of St. John is protected as part of the Virgin Islands National Park. The park covers approximately 7,259 acres of land on the island, which is about 60% of St. John's total land area.

The creation of the national park is largely thanks to the generosity of Laurance Rockefeller. In 1956, he donated about 5,000 acres of land to the federal government, which formed the core of the Virgin Islands National Park. This donation was pivotal in preserving much of the island's natural beauty and ecological diversity for future generations.

Cruz Bay - This is the location of the main harbor and "town" on St John.  All the mooring balls in Cruz Bay are private, so the closest you will be able to pick up a mooring ball is right around the point (Lind Point), which is a short dinghy ride.  There are two dinghy dock areas, one by the main "people" ferry dock and one near the National Parks Dock.  

IMPORTANT:   Be SURE to lock your dinghy when in Cruz Bay.  Sometimes, (especially with a little too much alcohol) dinghies tend to get a mixed up, so it is very important to lock secure yours.

Honeymoon and Caneel - The closest mooring field to Cruz Bay, this is a favorite area for the last night on charter.  There are tons of great restaurants and shops and is the main taxi area for getting around the island. 

Hawksnest - Quiet and secluded, Hawksnest is home to the smallest "charted" beach in the Caribbean, locally known as "Two-Butt Beach".  The other more famous beach within Hawksnest is Oppenheimer Beach, made famous for its historical significance as the former property of J. Robert Oppenheimer, the "father of the atomic bomb".  There is a distinctive red-roofed pavilion that was part of the Oppenheimer's estate.

Trunk Bay - Probably the most famous of all the beaches on St John, primarily because it is the most photographed beach in the Virgin Islands. There is a lookout on the drive above Trunk Bay that is a prime location for gorgeous and scenic photos.  

However, Trunk Bay is not recommended as an anchorage.  The mooring balls are quite far from shore and the swim in can be very difficult.  There are LOTS of cruise ship visitors here, lots of ferry wake, and it is much better to visit from shore than it is by boat. 

Cinnamon Bay - One of the longest beaches on island, stretching about a mile.  

C ruz Bay - There is  a fuel dock near the National Park Visitors Center, but "The Creek" can get very busy.  Especially, with all the ferry and day charter boats coming back in from the BVI.  It's better to plan ahead and avoid going into the fuel dock here, unless absolutely necessary.  

If you are asked by the Customs and Border Patrol office to clear "in person" when coming back from the BVI, "The Creek" is the area you'll be looking for.  

The Marketplace - Located in Cruz Bay, the Marketplace is home to the islands best supermarket, Starfish Market, Chelsea Drug Store, and many boutiques, art galleries, and gift shops.

What Does All-Inclusive Yacht Charter Mean?

To understand the prices listed in this article, it is important first to understand what an All-Inclusive Yacht Charter BVI means. –In yacht charters, two main contract types are used: CYBA ( Caribbean Yacht Brokers Association ) and MYBA ( Mediterranean Yacht Broker Association ). CYBA contracts, common in the Caribbean (all catamarans and some motor yachts), are all-inclusive except for gratuities and are in the industry referred to as “Caribbean terms.” MYBA contracts, used globally, are “plus expenses,” meaning fuel, food, and dockage are extra and handled through Advance Provisioning Allowance (APA).

What is Included in an All-Inclusive Yacht Charter?

Unless specified under the Special Conditions , the total all-inclusive charter fee includes:

This 88-foot Nordlund Motor Yacht with accommodation for 6 guests is really great value for money and has excellent client feedback ! Honestly, there aren’t many luxury yachts of this size and standard at this all-inclusive price! Prime Time is, therefore, also a very popular boat fully booked out every year; it is, therefore, important to reserve her in good time.

Prime Time is owned and skippered by American ex-navy Captain Joe Standish , who has lived and chartered in the BVI since 1999. Joe runs one of the oldest charter businesses in the BVI ; needless to say, his local knowledge and experience are second to none.

Exotica Charters Announces Availability of New Yacht Charter Locations Due To a Wide Adoption and Innovative Use of This Technology

The availability of yacht charters was long dependent upon available marinas that allow for resupply after every charter. As the average size of a crewed charter vessel increased from 45 feet to 90+ feet, they could hold much more supplies. Nowadays, there are only 2 items that need to be restocked frequently - fresh produce and water. Since most charter locations burst with fresh fruit and fish, only water needed to be solved.

myBVIcharter is the leading US yacht charter company offering a robust fleet of catamarans and motor yachts in the British Virgin Islands. The classic weekly itinerary sees all the yachts depart on Saturday in a counterclockwise direction towards Virgin Gorda and Anegada, looping on Tortola on the way back, with the last leg from Jost Van Dyke.

Depending on the day, yachts used to move like the “Spanish Armada”. As yachts started to adopt the water maker, they suddenly had more options to start from almost anywhere, as guests could be picked up on a tender. This means that travelers can start their charter on day 3, staying ahead of the main fleet while on the same itinerary.

In Greece, the effect is twofold as explained by Mo, the Charter Guru at myGreekcharter . Firstly, there are new ways to discover classic locations. Since the first yachts started allowing Santorini pickup/dropoff, other yachts chose to follow suit. Santorini does not have a marina, and the pickup with a tender was a game changer. The amount of water needed for 15 people made daily stocking impractical and the yachts chose to start and finish in Athens.

Secondly, new charter areas in Greece have become available. As new yachts continued to arrive, the Athens’ marinas were full around 2022. The new yachts needed to find new marinas. A fundamental question - “why do we need a marina?”, led to yachts operating in areas previously not touched by the crewed yachts - Sporades and Dodecanese islands.

As Daniel, the owner of DMA Yachting, explains, ”We’re seeing first 3-4 crewed yachts permanently stationed in the Sporades and 8-10 yachts in the Dodecanese. Previously, you had to charter from Athens and ideally take a 2-week charter. This is no longer the case - you can start almost anywhere.”

The situation with the motor yacht Bahamas is similar. The previously Nassau-centric model, where all yachts started in Nassau and went for a weekly “milk run” charter to the Exumas, is challenged. “People don’t want to charter in the same spot twice”, explains Mo. “With 2,400 Cays, why not start in Eleuthera or even Long Island? And if the charterer wants to start in Staniel Cay, why get there from Nassau? Start the charter there!”

The water maker is not a new technology. It’s been around for a long time. It’s the innovative use, wide adoption, and necessity to spend less or no time in the marina that made the yachts offered by myBVIcharter behave differently.

Due to over-tourism and overcrowding in mainstream locations, people seeking intimate retreats are becoming increasingly more interested in exotic spots like Thailand, Raja Ampat, Galapagos or Antarctica. A water maker onboard is the key technological change that made these new locations feasible.

Swim In Crystal-Clear Waters At This Wildly Underrated And Laidback Caribbean Island

Seven years after Hurricanes Irma and Maria swept through the British Virgin Islands, leaving a trail of destruction in their wake, Virgin Gorda is back. Some things have changed, but the essence of the island — long heralded as one of the most beautiful places in the British Virgin Islands — remains intact, so it's time to revisit the stunning island .

Located about 80 miles east of Puerto Rico, Virgin Gorda is the third largest in a string of about 60 islands that stretches along an archipelago between the Atlantic Ocean to the north and the Caribbean Sea to the south. Widely known as a premier sailing destination due in part to the proximity of individual islands creating a natural barrier that channels the steady trade winds while moderating their impact on the water, the British Virgin Islands caught the eye of the recreational sailing community in the mid-20th century. Virgin Gorda, in particular, drew sailors to its well-protected North Sound, where crystal-clear waters lap gently at the shore.

Three men who figured prominently in the development of Virgin Gorda as a vacation destination were part of that sailing community — Laurence Rockefeller, Basil Symonette, and Bert Kilbride. Each, in their own way, contributed to the laid-back tone that continues to define Virgin Gorda more than half a century later, making it especially appealing to both free-spirited sailors and landlubbers seeking friendly fun in the sun.

Virgin Gorda is a laid-back Caribbean destination

Symonette, an avid yachtsman who frequented Virgin Gorda's North Sound, purchased a one-mile stretch of shorefront acreage in the 1960s. He opened a bar, built five simple cottages, and christened the property The Bitter End. At about the same time, Rockefeller, a philanthropist and avid conservationist, was building Little Dix Bay, a luxe-but-simple resort on the other side of the island. A stone's throw from Bitter End, Kilbride was offering dive courses from a base at Saba Rock. Pirates' Pub, a thatched-roof beachfront bar, cemented the island's reputation as a go-to hangout for the region's sailing crowd.

While the dual hurricanes leveled all three of the island's earliest resorts, the current owners of each of these locations resolved to honor the founders' original visions during reconstruction, sticking with the Caribbean-casual attitude that has prevailed in Virgin Gorda since tourism took hold in the 1960s. The newly renovated Saba Rock and Little Dix Bay (now a Rosewood property) are welcoming guests again. The Bitter End Yacht Club, owned by the Hokin family in the 1970s and expanded over time to include about four-dozen hillside cabins, has been gradually reopening with a renewed focus on Symonette's vision of servicing the local sailing industry.

One thing that hasn't changed at all post-hurricane is Virgin Gorda's stunning natural beauty. In addition to the expansive vistas visible from atop its volcanic peaks, The Baths at beach level are among the island's biggest draws. Formed millions of years ago when molten rock oozed into layers of volcanic rock where it gradually cooled and set, the rocks were eventually exposed to the elements. Over time, sharp edges have softened to graceful curves, creating a labyrinthine landscape of towering boulders, crystal-clear tidal pools, and enchanting passages for vacationers to explore.

Other must-see points of interest around the island include the ruins at Copper Mine. The recently dedicated national park, located on a promontory on the island's southeast corner, centers on the remnants of a mid-19th-century copper mine and community settled by miners from Cornwall, England. For a good hike, head to Gorda Peak National Park, where trails lead to the highest point on the island. If you're into snorkeling, a daysail with one of Virgin Gorda's charter companies is an absolute must. Explore the kaleidoscopic underwater world at The Baths or head to premier snorkeling destinations at Spring Bay, Savannah Bay, Mahoe Bay, or at the nearby rock formation known as The Dogs.

When it comes to dining, Virgin Gorda's roster of eateries and watering holes runs the gamut from bohemian casual to romantic fine dining, including several options that offer unparalleled vistas. Located on a hill overlooking The Baths, Top of the Baths is a destination in its own right. There's a bar, restaurant, and on-site swimming pool. And since it's located at the trailhead for The Baths, it's the ideal setting for post-exploration tipple. Set on a hilltop overlooking North Sound, Hog Heaven is another island mainstay. The casual open-air eatery has a well-earned reputation as the place to go for barbecue and sunsets. If your plans call for a fancier setting with a stellar view, head for Sugarcane at Nail Bay. Reinvented after the 2017 hurricanes destroyed the original structure, the one-time burger joint reopened in 2019 as a more upscale eatery with poolside dining and great views.

Spanish Town has long been Virgin Gorda's main shopping destination, but the newly renovated Virgin Gorda Yacht Harbour, a mall-like development on the island's west coast, is gaining traction.

If you are obtaining a quote, information, booking travel for and/or securing or procuring a Charter (as that term is defined in Section 1 below) for more than just yourself, all references below to “Charterer” or “you” (and derivations thereof) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote, information, booking travel for and/or securing or procuring Charter.

These Terms shall be read together and construed, to the fullest extent possible, to be in concert with any other agreement by or among Broker and Charterer. To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

• Prepaid Charter Reservations . Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

• Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
• Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

• Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
• Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
• Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

• Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

• No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

• Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

• Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
• Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
• Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
• Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.
